Many Wyoming Services Move to Catalogs and Rate Schedules

 

·        On September 20, 2007, in compliance with Wyoming law the provisions applicable to Qwest’s competitive services and features moved from Price Schedules filed with the Wyoming Public Service Commission (the “Wyoming Commission”) to Catalogs (Qwest Corporation) and to Rate Schedules (Qwest Communications Corporation, and Qwest L D Corp.) that are set out on the Qwest Web site at http://tariffs.qwest.com:8000/Q_Tariffs/WY/index.htm.

·        Competitive interexchange telecommunications services and features provided by Qwest Communications Corporation and Qwest L D Corp. are governed by the Service Agreements at http://tariffs.qwest.com:8000/Qwest_Service_Agreements/LD_Xpl/index.htm.

 

·        When customers order services and products in the Price Schedule, the terms, conditions, charges and rates set out in the Price Schedule for the services and products so ordered govern and apply to those services and products, as a matter of law. They are the binding, lawful terms, conditions, charges and rates, effective between the customer and Qwest, and serve as the contract between Qwest and you for Commission regulated services set out in the Price Schedules. Any changes in the terms, conditions, charges and rates, modify and apply to the customer and Qwest, as a matter of law, upon an accepted filing with the Wyoming Commission.

 

·        As of September 20, 2007, most Qwest Corporation-offered services are provided under the Catalog Terms, instead of the Price Schedules. The terms, conditions, charges and rates in the Catalog Terms are the contract between a customer and Qwest for those services and products. Generally, Qwest provides the same competitive, non-discriminatory rates and services it provided before the move from Price Schedules to Catalog terms. However, by moving products and services from the Price Schedule to the Catalog Terms, Qwest will be able to respond to a customer's telecommunications needs more quickly.

 

·        The Catalog Terms are virtually identical to the Price Schedules that were filed with, and by implication approved by, the Wyoming Commission, and they are very, very similar to terms and conditions filed and approved in other states with other commissions. So, we are confident that the Catalog Terms are reasonable and fair, and consistent with the best practices in the industry.

 

·        No new agreement with Qwest is required when services move from a Price Schedule to a Catalog. During the transition from Price Schedules to Catalog Terms, Qwest has not changed any of the terms, conditions, charges and rates for the affected services and so the effective contract between Qwest and the customers remains the same. Existing contracts for services, term plan agreements, and other specific contracts or agreements with Qwest are not affected and the contract or agreement will continue until it expires.

 

·        As a user of any of the services or features covered by the Catalog Terms, you do not need to sign an agreement, but use of Qwest services constitutes acceptance of, and agreement to the terms and conditions of the Catalog Terms.

 

·        If you receive a non-price scheduled business service, other than intra- or interstate long distance, that is not covered by a signed contract or other effective agreement (including expired contracts or term agreements that have not been renewed), the Catalog Terms govern the provision of your Qwest service. A summary of certain important provisions in the Catalog Terms are outlined in the Notice of Terms and Conditions for Qwest Local Exchange Services (Business Services).

 

·        If you receive a non-price scheduled residential service, other than intra- or interstate long distance, the Catalog Terms govern the provision of your Qwest service, unless we provided you with a separate set of terms and conditions for the non-price scheduled residential service. A summary of certain important provisions in the Catalog Terms are outlined in the Notice of Terms and Conditions for Qwest Local Exchange Services (Residential Services).

 

·        If you subscribe to Qwest interstate or intrastate long distance, a summary of certain important provisions of the Catalog Terms, and the Catalog Terms themselves, can be found at http://tariffs.qwest.com:8000/Qwest_Service_Agreements/index.htm.

 

·        There has been no change in rates in connection with the move of the services and products to the Catalog Terms. Your rates will be displayed on this Web site, but they can be modified from time to time by making that change to the Catalog Terms. We will provide you with notice of important changes, such as rate increases.

 

·        You remain free to terminate the Catalogued or Rate Scheduled services at any time, unless you have signed or agreed to a term commitment or contract with Qwest for a specified time period. And you will be notified of important changes to your services in much the same manner that you were notified before. When Qwest makes important changes to your service, such as a price increase, you will be notified via bill messages, inserts or separate mailings. Changes that do not materially change your obligation, such as price decreases or changes in practices, may simply be made by changing the Catalog Terms.
