About Oregon Contract Terms

 

·        The terms and conditions for Qwest services can be found in our Tariffs and Catalogs. Links to these documents are provided at the end of this page.

·        As of February 15, 2007, Qwest Frame Relay Service, Asynchronous Transfer Mode Service, and Outward WATS and 800 Services are provided under Catalog Terms, instead of the Tariffs. The terms, conditions, charges and rates in the Catalog Terms are the contract between a customer and Qwest for those services and products. These products and services are no longer under the authority of the PUC.

 

·        If you receive a tariffed service, the Tariff and Price List governs the provision of your Qwest service. Tariffs and Price Lists for Oregon regulated services are filed with and approved by the Oregon Public Utility Commission (PUC) and serve as the contract between Qwest and you for Commission regulated services.

 

·        When customers order services and products in the Tariff, the terms, conditions, charges and rates set out in the Tariff and Price List for the services and products so ordered govern and apply to those services and products, as a matter of law. They are the binding, lawful terms, conditions, charges and rates, effective between the customer and Qwest. Any changes in the terms, conditions, charges and rates, modify and apply to the customer and Qwest, as a matter of law, upon an accepted filing with the Oregon Commission.

 

·        Qwest Catalogs contain the terms, conditions, charges and rates for Qwest's formerly tariffed services. If you receive a formerly tariffed business service not covered by a signed contract or other effective agreement (including expired contracts or term agreements that have not been renewed), the Catalog governs the provision of your Qwest service. As a user of any of the services or features in the Catalog, you do not need to sign an agreement, but use of Qwest services constitutes acceptance of, and agreement to the terms and conditions in the Catalog.

·        Qwest may change the terms and conditions of your formerly tariffed services by adding to or making changes to the Catalog or separate contract/agreement and giving you reasonable notice of important changes, such as rate increases, instead of filing them with the Commission.
